1. Ownership

All photos and content on the Website are created and owned by Karolina Grabowska unless explicitly stated otherwise.
All rights not expressly granted are reserved by the owner.

2. License to Use Photos

Photos on Kaboompics.com are provided under the Kaboompics License, which defines how you may download, use, modify, and distribute them.

Photos are available under two license types:

2.1 Kaboompics Standard License

You are granted an irrevocable, non-exclusive, worldwide copyright license to:

• Download, copy, edit, crop, and use the images for free

• Use them in personal and commercial projects, including but not limited to:

  • Websites, blogs, online stores

  • Printed materials (books, magazines, packaging, posters)

  • Social media, marketing, and advertising

  • Apps and presentations

Attribution is not required, but always appreciated.

You may not:

• Resell or redistribute the images as standalone stock photos, downloads, or prints

• Upload images to stock photo platforms or create a competing stock photo service

• Sell or distribute unmodified images as standalone products

• Use images for AI training, machine learning, biometric tracking, or facial recognition

• Use images in misleading, defamatory, unlawful, or deceptive ways

• Use images in ways that falsely suggest sponsorship or endorsement by any person, brand, or entity depicted in the image

• Use images of recognizable trademarks, logos, buildings, or products in commercial projects without appropriate permissions or assuming full legal responsibility

You may use Kaboompics photos as placeholders or as part of templates or mockups for your own use or client work — as long as the image itself is not the primary value of the product being sold (for example: you may not sell a “laptop mockup” that consists mainly of a Kaboompics photo).

2.2 Kaboompics Editorial Use Only License

Some images on Kaboompics are marked as Editorial Use Only. These may contain:

• Recognizable trademarks or logos

• Branded products

• Private buildings or artworks

• Identifiable people for whom no model release has been obtained

You may use Editorial Use Only photos only for non-commercial editorial purposes, such as:

• News articles

• Blog posts

• Non-commercial publications

• Documentary, educational, and journalistic contexts

You may not use these images:

• In advertising, marketing, or promotional materials

• In product packaging

• In merchandise or commercial projects

• In any AI/ML application

• In ways that suggest sponsorship or endorsement

Such images will be clearly marked Editorial Use Only on the site.

3. Third-Party Rights Disclaimer

While all images are owned by us, we do not grant you any rights to trademarks, logos, artworks, private buildings, recognizable designs, or identifiable people that may appear in the photos.
If you choose to use such images — whether marked as Editorial Use Only or not — you do so at your own risk and accept full responsibility for any legal claims from third parties (such as trademark owners, rights holders, or depicted individuals).
Kaboompics does not provide legal clearance for third-party intellectual property or privacy rights.

4. Images Containing People

All photos on Kaboompics that feature professional models — such as portraits, lifestyle photoshoots, or any images where the subject is clearly posed — are covered by valid model releases and can be used for commercial purposes under the Standard License, provided that the image is not used in a way that implies personal endorsement, participation, or recommendation by the person depicted. Where applicable, model releases are on file and available upon request for clients who require proof of release.
Images marked as Editorial Use Only may feature identifiable people for whom no model release has been obtained (such as people in public spaces, street scenes, crowds, or incidental presence). These images are intended for non-commercial editorial use only, and may not be used in advertising, product promotion, or other commercial contexts.
In all cases, users are prohibited from using photos of people in ways that are misleading, defamatory, unethical, or harmful, including but not limited to:

• Promoting political, religious, or controversial agendas without explicit consent

• Associating with illegal, harmful, or exploitative activities

• Use in adult, pornographic, or sexually explicit content

• Depicting individuals in a derogatory or offensive manner

If the author of the image or any depicted person objects to how an image is being used, Kaboompics reserves the right to challenge and request the discontinuation of that usage.

5. Kaboompics Shop — Premium Content

Kaboompics Shop is a section of the Website offering premium digital products — including exclusive photo packs, stock videos, mockups, and design resources.
All purchases in Kaboompics Shop are processed via Gumroad, a trusted third-party payment platform.
Payments, file delivery, and refund handling are governed by Gumroad’s Terms & Conditions. Kaboompics does not store or process any payment data on its own servers.
Purchased digital files from Kaboompics Shop are non-refundable, except as required by applicable law or under Gumroad’s refund policy.
By purchasing any premium content from Kaboompics Shop, you agree to the license terms stated on the product page or at checkout.
Each premium product may have a separate, specific license — and you must review and comply with that license before using the purchased content.
Premium content may not be used to create or sell competing stock or template products.
Unless otherwise stated, premium content purchased from Kaboompics Shop may not be resold, sublicensed, or redistributed as standalone digital products.

6. Kaboompics Secret Club & Newsletter

Kaboompics Secret Club is an exclusive section of the Website, accessible only to subscribers of the Kaboompics newsletter.
By subscribing to the newsletter, users automatically gain access to Secret Club, where they can download additional free resources — such as extra photos, mockups, and other creative content.
By subscribing, you agree to receive email updates from us — including news about new resources, special offers, and other updates related to Kaboompics.
You can unsubscribe from the newsletter at any time, which will automatically revoke access to the Secret Club and its content.
Content provided through Secret Club is subject to the same licensing terms as the rest of Kaboompics content, unless stated otherwise for a specific resource.
We reserve the right to modify or discontinue the Secret Club or the newsletter at any time.

7. Age Restrictions

Kaboompics is intended for users aged 16 and older. If you are under 16, you may only use this Website with the consent of a parent or legal guardian.
We do not knowingly collect personal data from children under 16. If we become aware that such data has been collected without parental consent, we will take steps to delete it.

8. Prohibited Conduct

Users of Kaboompics agree not to engage in the following prohibited activities:

• Using images or other content from Kaboompics in any unlawful, misleading, defamatory, or offensive manner

• Claiming ownership of images or redistributing them as part of another stock photography platform

• Using images in ways that violate the rights of third parties, including but not limited to copyright, trademark, and privacy rights

• Uploading Kaboompics images to AI tools, databases, or platforms for AI training, enhancement, or modification

• Attempting to disrupt, hack, or interfere with the normal functioning of the Kaboompics website

• Engaging in activities that violate any applicable laws or regulations

• Misrepresenting an association with Kaboompics, including falsely implying sponsorship, endorsement, or partnership

9. Disclaimer and No Warranties

Kaboompics provides all images and content on an “as is” and “as available” basis, without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We make no representations or guarantees regarding the accuracy, reliability, or completeness of the images and do not warrant that they will be free from defects, errors, or legal restrictions in all contexts.
Users bear full responsibility for ensuring that their use of the images complies with all applicable laws, including but not limited to intellectual property, privacy, and commercial usage rights.
Kaboompics disclaims all liability for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use the images or the Website.
By using Kaboompics, users acknowledge and accept full responsibility for any consequences arising from their use of the images and content provided on the platform.

10. Limitation of Liability

While Kaboompics ensures that all images comply with legal requirements at the time of publication, we do not assume responsibility for how users utilize them.
Some images may contain recognizable products, logos, or designs that are protected by trademark, industrial design, or other intellectual property laws. It is the sole responsibility of the user to ensure that their use of such images does not infringe upon third-party rights, particularly in commercial contexts.
To the maximum extent permitted by law, Kaboompics shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the Website or its content.
This includes, but is not limited to, financial losses, business interruptions, reputational damage, or legal disputes resulting from the use of images.
Users acknowledge that they are solely responsible for their use of the images and agree to indemnify and hold harmless Kaboompics against any claims, damages, or legal actions resulting from their usage.
Kaboompics does not accept liability for any third-party services, such as payment processing through Gumroad, and shall not be held responsible for any issues arising from transactions made via external platforms.

11. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of Poland, without regard to conflict of law principles.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Poland.
We reserve the right to seek injunctive or equitable relief in any jurisdiction where such action is necessary to protect our intellectual property rights or enforce these Terms.

12. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of the Website constitutes acceptance of any updated Terms.
